Theory of Database Assignment Question 1

1. What ethical / legal issues need to be considered when implementing this database? Explain

When creating a database especially regarding music, copyright and downloading are key issues. When creating the task students should regard the rights of the artist or band used as well as their music and other files used within the database. These rights include:

Moral Rights
Moral rights are the personal legal rights belonging to an individual that cannot be subjectively sold, re-established, transferred or assigned. Which means consent is needed from the creator as well as authorization from the copyright owner to avoid legal action. The creator also has a right of integrity, which is the right not to have their work to be themed to offensive treatment. Offensive treatments include prejudice towards the creator’s honour or reputation, which for example is disfiguring or altering the creator’s product. Offensive treatment has severe consequences.

Copying music files or CDs
In regards to copying music certain laws apply such as music should be copied or recorded only for personal use and not for the use of others. This is difficult as the task requires a music sample for the database which will be viewed be others, and in turn they will be though indirectly using it.
It is illegal if:
- You sell the copy or original file or CD
- Give out the copy or original file or CD
- Air the copy or original file or CD
If any of the acts are committed the original or the copy therefore becomes a violating copy.

Songs used in the database could be accessed illegally through an unlicensed user through the internet and various programs such as Limewire and Morpheus which in turn violates the artist or bands legal rights.
